These Terms & Conditions ("Terms") govern your access to and use of theunwriting.com (the "Site") and your purchase or use of any digital products, courses, coaching, resources, or other services offered by The Unwriting ("The Unwriting," "we," "us," or "our").

By accessing the Site, purchasing a product or service, registering for an account, or otherwise using The Unwriting, you agree to these Terms. If you do not agree to these Terms, please do not use the Site or purchase our products or services.

1. About The Unwriting

The Unwriting provides educational and informational content relating to personal growth, self-reflection, mindset, wellness, creativity, identity, and related areas of personal development.

Our content and services are designed to support reflection and personal development. They are not intended to provide medical, psychological, psychiatric, therapeutic, legal, financial, or other professional advice.

2. Eligibility

You must be at least 18 years old to purchase or participate in paid services offered by The Unwriting unless we expressly state otherwise.

By using the Site or purchasing a product or service, you represent that you are legally capable of entering into an agreement.

3. Educational and Self-Help Disclaimer

The information and materials provided through The Unwriting, including articles, videos, courses, exercises, digital products, coaching sessions, worksheets, and other resources, are provided for general educational, informational, wellness, and personal-development purposes.

The Unwriting is not a healthcare provider, mental-health provider, therapist, psychologist, psychiatrist, physician, or other licensed healthcare professional.

Nothing provided through The Unwriting is intended to:

  • diagnose a medical or mental-health condition;

  • treat, cure, or prevent a disease or disorder;

  • replace therapy, counseling, medical care, psychiatric care, or other professional treatment;

We do not guarantee that any particular product, course, coaching session, exercise, strategy, or resource will produce a particular result or outcome.

Any examples, testimonials, stories, or statements about possible results are illustrative and should not be understood as guarantees of what you will personally experience.

Your results depend on many factors, including your individual circumstances, decisions, participation, and implementation.

5. Digital Products and Courses

The Unwriting may offer digital products, courses, workbooks, recordings, videos, audio materials, written materials, and other downloadable or online resources.

When you purchase a digital product, you receive a limited, personal, non-exclusive, non-transferable right to access and use the product for your own personal, non-commercial purposes.

Unless we expressly authorize otherwise, you may not:

  • reproduce the product;

  • copy or redistribute course materials;

  • resell or sublicense access;

  • share your login credentials;

  • upload our materials to file-sharing services;

  • publish our materials online;

  • use our materials to create a competing commercial product; or

  • otherwise distribute the materials to third parties.

We may suspend or terminate access to digital products if we reasonably believe that an account or purchase is being used in violation of these Terms.

6. Account Access

Certain products or services may require you to create an account.

You are responsible for keeping your login credentials confidential and for activity occurring through your account.

You agree not to share your account credentials with another person.

If you believe that someone has accessed your account without authorization, please contact us promptly.

7. Purchases and Payments

Prices for products and services are displayed on the Site at the time of purchase.

We reserve the right to change prices, products, services, or offers at any time. A price change will not affect a purchase that has already been completed unless otherwise required by law.

Payments are processed through the payment systems available through Squarespace and its payment-processing partners.

By submitting an order, you represent that the payment information you provide is accurate and that you are authorized to use the applicable payment method.

8. Refunds and Cancellations

Refund eligibility depends on the particular product or service purchased and any refund policy presented to you at the time of purchase.

Where a product or service has a specific refund or cancellation policy, that policy forms part of these Terms.

For digital products, access to digital content may begin immediately after purchase. Where permitted by applicable law, you acknowledge that immediate access to digital content may affect your right to cancel or receive a refund.

For coaching appointments, cancellation and rescheduling terms may be provided separately in the applicable Coaching Agreement or booking page.

Nothing in this section limits any mandatory refund, cancellation, or consumer rights that cannot legally be waived.

9. Coaching Services

The Unwriting may offer one-on-one coaching or other personal-development services.

Coaching services are educational and personal-development services and are not therapy, psychotherapy, counseling, medical treatment, or psychiatric care.

Coaching is intended to help you explore ideas, perspectives, habits, goals, and personal-development questions. You remain responsible for your own decisions, choices, actions, and outcomes.

A separate Coaching Agreement may apply to individual coaching services. Where applicable, that agreement forms part of the agreement between you and The Unwriting.

10. Coaching Confidentiality

We respect the personal nature of coaching conversations and will handle information you share with reasonable care and in accordance with our Privacy Policy.

However, coaching communications should not be assumed to have the same legal confidentiality protections that may apply to communications with licensed healthcare professionals, attorneys, or other regulated professionals.

We may disclose information when required or permitted by law, including where necessary to comply with legal obligations or protect the rights, safety, or property of The Unwriting or others.

Please review our Privacy Policy for additional information about how we collect, use, and disclose personal information.

11. Intellectual Property

Unless otherwise stated, the Site and its contents are owned by or licensed to The Unwriting.

This includes, without limitation:

  • workbooks;

  • exercises;

You retain ownership of content that you submit.

However, by voluntarily submitting content for publication, such as a testimonial or review, you grant The Unwriting a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for purposes related to operating, promoting, or marketing The Unwriting, subject to applicable law.

We will not knowingly publish your private communications as a testimonial without your permission.

If you do not want us to use a testimonial or other submission for promotional purposes, please let us know.

We do not control third-party websites and are not responsible for their content, availability, security, privacy practices, or terms.

This means that we may receive a commission when you purchase certain products or services through links on our Site.

Affiliate relationships do not change the price you pay unless otherwise stated.

We aim to recommend products and services that we believe may be useful to our audience.

To the fullest extent permitted by applicable law, our total liability arising from your use of the Site or purchase of a product or service will not exceed the amount you paid to The Unwriting for the particular product or service giving rise to the claim during the applicable period preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless The Unwriting, its owners, operators, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising from:

  • your violation of these Terms;

  • your misuse of the Site or our products or services;

  • your violation of another person's rights; or

  • your unlawful or unauthorized use of our materials.

20. Dispute Resolution

Before initiating formal legal proceedings, we encourage you to contact us and attempt to resolve any dispute informally.

If a dispute cannot be resolved informally, it will be governed by the laws of the State of South Carolina, without regard to conflict-of-law principles, except where applicable law provides otherwise.

Any dispute will be resolved in the courts located in York County, South Carolina, unless applicable law requires otherwise.

Nothing in this section limits rights that cannot legally be waived.

We may update these Terms from time to time.

When we make changes, we will update the "Last Updated" date at the top of this page.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

If a material change affects an existing purchase or contractual relationship, we will provide notice where required by law.

22. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect.

These Terms, together with our Privacy Policy and any applicable Coaching Agreement, purchase terms, refund policy, or other terms expressly incorporated by reference, constitute the agreement between you and The Unwriting regarding your use of the Site and our products and services.
